Falling behind is far more common than most owners realize, and it's rarely about carelessness. We find out exactly what the IRS says you're missing, rebuild the numbers for each year, and file in the order that limits penalties and protects any refunds you still have time to claim.
Many owners hold off because they can't cover the balance. That's the most expensive choice available, because the IRS penalizes not filing much more heavily than not paying.
| Penalty | Cap | |
|---|---|---|
| Failure to file | 5% of the unpaid tax for each month the return is late | 25% |
| Failure to pay | 0.5% of the unpaid tax for each month | 25% |
Unfiled years also put refunds at risk and delay loans, since lenders want to see filed returns. Filing stops the larger penalty immediately, and we can usually begin work within days of your consultation.
Owners often assume they can't file because the paperwork is gone. Most of it can be recovered. Banks and card companies keep statements for years, payment processors and payroll providers can reissue reports, and the IRS keeps a record of every W-2 and 1099 filed under your name. Between those sources, we can usually reconstruct an accurate, supportable return even when the original files no longer exist.
That's the pattern behind nearly every case we see. If the numbers are clean each month, the return is a routine step at year-end. If they aren't, the deadline arrives, and there's nothing reliable to file from. After we bring you current, we set up the books and software so next year's return is ready when it's due.
After your free consultation, we are glad to meet in person anywhere in the Greater Austin area and sort through everything with you. Owners anywhere else in the country work with us by phone and video, with documents shared securely online. We also handle overdue Texas franchise tax reports and help restore good standing with the Comptroller.
Every required return is technically still due, though the IRS generally looks for the last six years to consider you back in good standing. We review your IRS records first, so you'll know exactly which years apply to you.
The first call is free and confidential. Tell us roughly how far behind you are, and you'll leave knowing which years matter and what happens first.
